GAWRONSKI v. HOSPITAL, ET AL.

State of Wisconsin/Circuit Court/Sauk County
Medical Malpractice
Jury Trial

In a nine-day medical negligence trial, Corneille Law Group secured a verdict in favor of a hospital and an emergency medicine physician. Plaintiff claimed that hospital staff and the physician failed to ventilate a pediatric patient who presented to the emergency department with seizures and the failure resulted in an anoxic brain injury. Defendants contended that the patient suffered from a rare reaction to medication that prevented ventilation, and hospital staff and the physician met the standard of care in all respects. The parties stipulated to special damages; standard of care and causation remained contested at trial. After a brief deliberation, the jury found no negligence on the part of the hospital or the physician.
