Bearden v. DPM, et al.

State of Wisconsin/Fond du Lac County/Circuit Court

Attorneys Mark Budzinski and Aaron Baratz of Corneille Law Group LLC successfully defended a Doctor of Podiatric Medicine and an Advanced Practice Nurse Practitioner in a medical malpractice case, securing a no-negligence verdict.

The case involved allegations by the plaintiff that the Doctor and APNP failed to properly monitor and assess the condition of plaintiff's left leg after tarsal tunnel syndrome surgery, leading to an amputation. Plaintiff claimed that the defendants were negligent in not properly assessing and testing the foot before surgery and in failing to recognize post-operative ischemia.

Over the course of the four-day trial, the defense team effectively demonstrated that the Doctor and APNP provided appropriate care within the standard of care. They highlighted that multiple independent medical evaluations had concluded the plaintiff had adequate vascular perfusion in his leg between the surgery and amputation. Additionally, expert testimony suggested that the plaintiff's undiagnosed stomach cancer, subsequent treatment, and resulting malnutrition were unforeseen factors beyond the defendant's control that contributed to the outcome. The case serves as a strong example of Corneille Law Group's commitment to the zealous advocacy and defense of their clients, and willingness to “go the distance” and try cases to verdict.
